Fifteen years in the making and with only one building completed so far, the 325 Blake Road project in Hopkins faces ongoing uncertainty over where it is headed next.
On Thursday, the Hennepin County District Court ruled in favor of the Minnehaha Creek Watershed District in a lawsuit filed by Alatus that alleged the watershed, among other things, unlawfully terminated the purchase agreement with Alatus.
According to a summary judgment provided by the court, the court found that the plain language of the contract allowed MCWD to unilaterally terminate the purchase agreement, that the cooperative agreement between the three parties was not a joint powers agreement and that MCWD did not breach any contractual obligation to Alatus under the preliminary development agreement.
Just two days before to the court’s findings, the city of Hopkins announced a formal end to its partnership with the Minnehaha Creek Watershed District over the 325 Blake Road development, including an interest in starting or continuing litigation in some capacity to “recoup taxpayer costs.”
