The Minnehaha Creek Watershed District (MCWD) is currently reviewing a permit application and variance request for a project at 4685 West Branch Rd in Orono. The project, proposed by Ryan Ortlip, involves the construction of a driveway to access the property.

MCWD reviews for compliance only with applicable MCWD rules. This project triggers our Erosion Control, Waterbody Crossings & Structures, Wetland Protection, and Floodplain Alteration rules. The city, county, or another public agency may require other permits or approvals.

Since this project involves a variance request under the Waterbody Crossings & Structures rule, it will be presented to the Board of Managers on October 24th. However, please be aware that the meeting date is subject to change.

The variance request pertains to Waterbody Crossings & Structures, specifically under Criteria – Part B: Retaining adequate hydraulic capacity. According to MCWD rules, a project within a watercourse must not cause an increase in upstream or downstream flood stage. However, the proposed project would result in an increase in upstream flood stage. The applicant has explored various alternative designs, but none were able to feasibly comply with MCWD rules.
